2. Use of the site

You may use this website for lawful purposes related to buying, selling, recycling, or transporting IBC totes. You agree not to misuse the site, submit false information through our forms, attempt to disrupt its operation, or use automated systems to overload it. The content here is provided for general information and does not constitute regulatory, legal, or safety advice for your specific application.

3. Quotes and estimates

Prices and availability quoted through the form or by email are estimates based on the information you provide and current stock. They are not binding offers and may change until we confirm an order in writing. A contract is formed only when we issue a written confirmation of your order and terms. Freight rates in particular are subject to carrier availability and fuel surcharges at the time of shipment.

4. Product condition and grade — used goods

We sell used, reconditioned, and rebottled IBC totes as well as new units. Used and reconditioned goods are sold at the grade and condition stated in your quote — for example, the wash level, last-contained product, cage type, and UN/DOT rating where provided.

You, the buyer, are responsible for verifying that a tote is suitable for your intended use before filling it. This is especially important for food-grade, potable-water, and consumable applications: you must confirm the prior contents and cleanliness meet your regulatory and safety requirements. 5. No warranty beyond stated grade

Except for the specific grade and condition described in your order confirmation, products are provided "as is," and we disclaim all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. We do not warrant that a used tote is suitable for any purpose beyond its stated grade.

6. Freight and risk of loss

Unless your order confirmation states otherwise, risk of loss passes to the buyer upon delivery to the carrier. Please inspect all shipments on arrival and note any damage on the delivery receipt before signing. Report visible freight damage or shortages promptly so we can help you file a carrier claim. Delivery timeframes are estimates and not guaranteed.

7. Limitation of liability

To the fullest extent permitted by law, IBC Tote Recycling Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site, our products, or our services. Our total liability for any claim relating to a product or service shall not exceed the amount you paid for that product or service. Nothing in these terms limits liability that cannot be limited under applicable law.

8. Intellectual property

The content, design, text, graphics, and logos on this site are the property of IBC Tote Recycling Services or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, or redistribute site content for commercial purposes without our written permission.

These terms are governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to its conflict-of-laws principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Illinois.
